Terms

Terms of Service

The agreement between you and Cachejay when you use the Mac app, cachejay.com and the connectors for ChatGPT, Claude and other AI apps. Written to be read.

Who we are

Cachejay is operated by Silver Mountain Technologies, LLC, doing business as Cachejay ("Cachejay", "we", "us"). You can reach us at hello@cachejay.com. By creating an account or using Cachejay you agree to these terms. If you use Cachejay for a company, you agree on its behalf and confirm you're allowed to.

The service

Cachejay is a Mac app and a web service. The app reads text from the apps on your screen, takes small screenshots, transcribes calls on your Mac, and writes notes about your work. Those notes and captures are kept in your Cachejay account so you can read them at cachejay.com/app and so AI apps you connect, such as ChatGPT and Claude, can look them up. Privacy describes exactly what is captured, what isn't, and what leaves your Mac.

We change and improve Cachejay over time. If we remove something important that you pay for, we'll tell you first.

Accounts

  • You sign in with your email (a link or code we send you) or with Google or Apple. Keep access to that email secure: whoever can read it can sign in as you.
  • One account is for one person. An individual plan covers up to 3 Macs that you use.
  • You must be at least 18, or the age of majority where you live, to use Cachejay.
  • Tell us at hello@cachejay.com if you think someone else has used your account.

Plans and billing

  • Trial. 14 days free, with no card. When it ends, Cachejay stops recording until you subscribe.
  • Individual. $12 a month or $120 a year.
  • Teams. $18 per seat per month, bought by the team's owner, covering every member in those seats.
  • Payments are handled by Stripe. Plans renew automatically at the end of each period until you cancel. Prices don't include taxes, which are added where required.
  • If we change a price, we'll tell you at least 30 days before it applies to your next renewal.

Cancelling

Cancel any time from Account › Manage billing at cachejay.com/app. Your plan keeps working until the end of the period you've paid for, and isn't renewed. Payments already made aren't refunded, except where the law requires it; if something went wrong, email us and we'll look at it.

When a trial or plan ends and isn't renewed, everything in your Cachejay account in the cloud is deleted 60 days later and every connected AI app is disconnected. What's on your Mac stays on your Mac. You can also delete your cloud data yourself at any time.

Acceptable use

Cachejay records what's on a screen and what's said on calls, so these rules matter:

  • Only on your own Mac. You may only run Cachejay on a Mac you use yourself, signed in to your own account. You may not install it on someone else's computer, or use it to monitor, track or record other people's activity. An employer may not use Cachejay to watch employees.
  • Calls and consent. If you transcribe a call, you are responsible for telling the people on it and for following the recording and consent laws that apply to you and to them. Some places require everyone on a call to agree before it is recorded or transcribed. If you can't get consent, don't transcribe the call: pause Cachejay or turn call transcription off.
  • Not for regulated data. Don't use Cachejay to store or process protected health information (we don't sign HIPAA business associate agreements) or payment card data. Mark apps that show this kind of data as private so Cachejay never reads them.
  • Don't use Cachejay for anything illegal, to infringe anyone's rights, or to harass anyone.
  • Don't try to get into other accounts, probe or disrupt the service, get around limits or billing, or copy, resell or reverse engineer Cachejay, except where the law allows it.

We may suspend or close an account that breaks these rules. Where we reasonably can, we'll tell you first and give you a chance to fix it.

Your content

What Cachejay captures and writes for you (screen text, screenshots, transcripts, notes, to-dos) is yours. You give us permission to store, process and send it only as needed to provide Cachejay to you: to sync it, search it, write your notes, and answer the AI apps you connect. We don't sell it, and we don't use it to train AI models.

If you share a project with a team, its teammates can read that project's notes and call notes until you stop sharing it. See what a team can see.

Companies we rely on to run Cachejay are listed on Subprocessors. If you use Cachejay for a company, our Data Processing Addendum applies too.

AI features

  • Notes, summaries and to-dos are written by AI. By default Cachejay sends that text, with secrets masked, to Anthropic's Claude through its API. You can choose Apple's on-device model, an AI tool on your Mac, or your own Anthropic, OpenAI or Google Gemini API key instead; with your own key, that provider's terms also apply.
  • AI makes mistakes. Notes can miss things, mishear names or get facts wrong. Check anything important before you rely on it.
  • When you connect an AI app such as ChatGPT or Claude, what it reads from Cachejay becomes part of your conversation with that provider, under its terms.

Our software

We give you a personal, non-transferable right to use the Cachejay app and service while your account is in good standing. Cachejay itself (the app, the site, the name and the jay) belongs to us. If you send us feedback or ideas, we may use them without owing you anything.

Disclaimers

Cachejay is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Cachejay will be uninterrupted or error-free, that it will capture everything, or that notes written by AI will be accurate. Keep your own copies of anything you can't afford to lose.

Limitation of liability

To the extent the law allows, Cachejay won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if we were told they were possible. Our total liability for any claim about Cachejay is limited to the greater of the amount you paid us in the 12 months before the claim and $100.

Some places don't allow some of these limits, so they may not all apply to you.

Indemnity

If someone makes a claim against us because of how you used Cachejay (for example, transcribing a call without the consent the law required, or installing Cachejay on someone else's computer), you'll cover our reasonable costs of dealing with it.

Ending this agreement

You can stop using Cachejay and delete your account at any time. We can end these terms or close an account for a serious or repeated breach, or if we stop offering Cachejay; if we stop offering it, we'll give you at least 30 days' notice and refund any time you've paid for and not used. The sections on your content, disclaimers, limitation of liability, indemnity and governing law continue after the agreement ends.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in Delaware, unless the law where you live gives you the right to bring them there instead.

Changes to these terms

We may update these terms. If a change is material, we'll email you or tell you in the app at least 30 days before it takes effect. Continuing to use Cachejay after that means you accept the new terms. The date at the top shows when they last changed.

Everything else

These terms, with the Privacy page and, for companies, the DPA, are the whole agreement between us about Cachejay. If one part can't be enforced, the rest still applies. Not enforcing a term isn't a waiver of it. You can't transfer this agreement without our consent; we may transfer it to a company that takes over Cachejay.
